Terms of Service

These terms govern your use of Initial (the “Service”), operated by Initial (“we,” “us”). By creating an account or using the Service, you agree to these terms.
The Service
Initial is an email assistant. When you connect a mailbox, the Service classifies incoming mail, applies labels, archives messages according to your instructions, answers questions about your mail in chat, and produces summaries. You direct its behavior through instructions and settings; automated actions run on your behalf under the authorization you grant.
Your account
You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account. You must be at least 13 years old (or the age of digital consent where you live) to use the Service.
Your authorization
Connecting a mailbox grants the Service permission to read and modify mail in that mailbox as needed to provide its features — for example, applying labels and archiving messages. You can revoke this authorization at any time by disconnecting the inbox in the product or from your Google Account permissions. You represent that you have the right to connect any mailbox you connect.
Acceptable use
You agree not to:
- use the Service to violate any law or the rights of others;
- attempt to gain unauthorized access to the Service or another user’s data;
- interfere with or disrupt the Service, including circumventing rate or usage limits;
- resell or provide the Service to third parties without our agreement;
- use the Service to send spam or unlawful communications from your mailbox.
AI-generated content and automated actions
The Service uses artificial intelligence to classify mail, generate summaries, and draft text. AI output can be wrong. The Service is designed so your mailbox remains the source of truth — archived mail is never deleted by the cleaner and remains in your mailbox — but you are responsible for reviewing AI-drafted content before sending it and for the instructions you give the assistant.
Fees
We may offer paid plans. Pricing, trial terms, and billing will be presented before you are charged. We may change pricing with notice; changes apply at your next billing period.
Your data
Our Privacy Policy describes what we collect and how we handle it, including Gmail data. You retain all rights to your content; you grant us the limited license needed to operate the Service on your behalf.
Intellectual property
We retain all rights in the Service. These terms do not grant you any right to our trademarks, branding, or software beyond use of the Service as provided.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these terms, to protect the Service or other users, or if required by law. Upon account deletion, we delete your data as described in the Privacy Policy.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CLASSIFICATIONS OR CONTENT WILL BE ACCURATE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100).
Changes to these terms
We may update these terms. If a change is material, we will notify you in the product or by email before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Massachusetts.
